Theoretical background and genesis of Freedom of Speech and Expression:- The right to freedom of thought and expression, along with the freedom of speech and press, has been highly valued by all the democratic countries because it is considered as fundamental for the development of human personality.

As such, poets, philosophers and political scientists have passionately pleaded for freedom of speech and expression. J.S. Mill strongly advocated for the liberty of thought and speech and wrote, “If all mankind minus one, were of one opinion, mankind would be no more justified in silencing mankind.” Harold J. Laski opines: “To allow a man to say what he thinks, is to give his personality the only ultimate channel of free expression, and his citizenship the only means of moral adequacy.”
